Marty m is considering the acquisition of land at 23 Mystery Road, Mermaid Beach owned by Darlene. The adjoining properties owned by up, Helen and the Pizza Restaurant have been developed. up, Helen's land has a small shack and tidy gardens, but nobody has seen 1);, Helen for some time as she is elderly and spending her autumn years with her family in her homeland of Switzerland. The land owned by the Pizza Restaurant has been developed with a two-storey premises being a combined residential and commercial building for the operation of the takeaway restaurant and residential apartment accommodation above. The land located at 23 Mystery Road, Mermaid Beach is positioned directly on the beach and is in a very desirable location. As part of the inspection of the land, Marty noticed a large bronze statue in the garden and thinks this would be of great use in his development of the land. He also notices the dwelling on the land. In undertaking a Current Title Search, the following interests were identied in relation to 23 Mystery Road: I No other interest registered on Title. Prior to the purchase of the land, Marty acknowledged the existence of the following interest: - Short term lease that Ruth holds with Darlene for a period of 2 years. Although, Marty is aware of Ruth's short-term lease he does not plan on being bound by it as he believes it is an unregistered interest and not protected by the law. Therefore, Marty plans to start developing the land once settlement has been Winespeotive of the lease. Note: 6 months of the original term of the short-term lease has passed. It came to Marty's attention that in order to have access to 23 Mystery Road, the previous landowners have crossed over the Pizza Restaurant's land. Without access through the Pizza Restaurant's land, 23 Mystery Road is landlocked. Marty found no other interest registered on Title and therefore would need to prove that this interest exists at common law in order to enforce it and potentially register the interest.
