The collective bargaining process is supported by the National Labor Relations Act (NLRA) or the Wagner Act which was passed in 1935 to help form unions because workers were not treated fairly in the workplace. The NLRA helped workers fight unemployment due to unfair treatment in the workplace during the Great Depression. This focuses on the rights of employees and establishing rules and regulations for employers to follow. Unions were formed in certain industries so they can collectively bargain after filing grievances and if the employer isnt helping, they will have a 3rd party hear both sides and make a final decision after all evidence is presented on both sides. The reason the collective bargaining process is so important is that this process is used to settle any disputes that may result in lawsuits, the downfall of a company, losing employees, etc. The Bargaining collective process is imposed so it can help the economy. According to Noe, the introduction to the NLRAs first paragraph states that it is in the national interest of the United States to maintain full production of its economy. (Noe 2023, p. 633) To my understanding, this means that this is for the protection of the economy and not necessarily solely for the protection of employees. The only industry that has no protection against the NLRA or collective bargaining process is the Farming and Agriculture Industry. This is because if farmers/workers go on strike will slow down the production of food and cause a lot of issues. This is why workers in that industry are not paid as much and a lot of immigrants are able to work in that industry. The collective bargaining process starts off with a grievance. It could be something like a wage issue. Workers want an increase in pay, and they feel they are not being compensated appropriately. After a grievance is filed through a union member or representative. It goes through a collective bargaining process where a third party will either dismiss it, the employer will settle or if the employee is not satisfied with the outcome, it could go further. Employees can go on strike or have a lockout where they refuse to work until their demands are met. For example, a recent strike from Starbucks in December was one of the biggest ever. Their demands are to have an increase in wages, better working conditions, and treatment from managers benefits, Starbucks employees had complained in the past that they wanted to form Unions so they can protect their employees and they can collectively bargain for benefits, higher wages, etc. Overall, the collective bargaining process is important because it can cause problems in the economy if workers are not treated fairly because it causes a domino effect like it did in the Great Depression.
