Neither Title VII of the CRA nor recent supreme court rulings regarding same sex marriage offer any protections regarding discrimination on the basis of sexual identity, orientation, or expression. So at the federal level, protection against such discrimination in the workplace does not exist. At the state level protections vary from state to state, with some states enacting anti-discrimination laws regarding gender identity and others offering little or nothing. So legal compliance alone offers no protection to individuals on the basis of their gender identity or sexual orientation. Ethical minimums, corporate social responsibility, and ethical maximums thus come in to play here. The Human Rights Campaign and Corporate Equality Index (CEI), in its 2022 Evaluation of 1271 companies -- including around 80% of Fortune 500 companies and many companies on the AmLaw 200 (American Law Society's highest revenue grossing firms), awarded 842 perfect scores regarding LGBTQ inclusivity in employment policies and benefits. Compare this with 13 of 319 in its inaugural study in 2002.
