Question Three (6 marks) Alison and some of her Purinta group purchased a prefabricated tin shed from a hardware store. They screwed it together in half a day, and placed it on a levelled piece of ground near one of their sacred sites on Scrubby Station. The guttering on the shed is connected by plastic pipes to a rainwater tank, which is also resting on the ground. The shed has a couple of solar panels, and combustion stove and gas cooker inside. If the weather is bad during ceremonial periods Alison and the group sleep in canvas swags in the shed. At other times they padlock it and keep personal belongings there. Annoyed by the native title claim, the fee simple owner of scrubby station (Bill Bailey) orders the Purinta off his land. He says the shed is now Scrubby Creek station property and must be left behind. Advise Alison as to whether she and the Purinta group are entitled to remove the shed (6 marks). You are not required to consider any adverse possession claim in this question. If the question contains insufficient information explain why, and explain how such additional information would be relevant to your answer.
