When the most recent changes to the Bankruptcy Code wereproposed, one of the provisions was to allow the Bankruptcy Court to utilize the judicial power of cramdown on real estate. This provision was eventually removed from the final law. Since we are slowly recovering from the depths of an economic downturnlargely fueled by large lossesof real property value, especially residential, wouldn't the power ofa cramdown allow the court to address this issue, at least in the confines of Bankruptcy?
