SUBJECT: Family Medical Leave Policy

Thank you for indicating at our last staff meeting employees can contact you with questions about our company's family medical leave policy. I have worked for the company for two years, but I have not had occasion to use this benefit. My father has been diagnosed with a serious illness, and I may need to take some time off from work to help care for him. My questions about the policy are listed below:

  • Is caring for a parent covered by family medical leave?
  • If I take family medical leave, will I still have a job with the company when I want to come back to work?
  • How long may I take family medical leave?

Please give me answers to these questions and provide any other relevant information about the policy that you think will be helpful.

Company's FMLA Policy:

In accordance with the Family Medical Leave Act (FMLA), the company will provide up to 12 weeks of unpaid job-protected leave for certain medical and family-related reasons for eligible employees. The employee has a right to come back to work at his or her former position, salary, benefits, and status or an equivalent position.

To be eligible for FMLA benefits, an employee must:

  • Work for a covered employer (our company is a covered employer);
  • Have worked for the employer for a total of 12 months;
  • Have worked at least 1,250 hours over the previous 12 months; and
  • Work at a location in the United States or in any territory or possession of the United States where at least 50 employees are employed by the employer within 75 miles. (Our location meets this requirement.)

Reasons for taking the leave include:

  • Childcare after the birth or adoption placement of a child.
  • Care for a spouse, child, or parent with a serious health condition.
  • Serious health conditions that make the employee unable to perform job duties.

At the employee's option, he or she may substitute paid time off for some of the leave. The following are specific requirements as stated by law:

  • Employees' requests should be in writing and approved by their managers.
  • Medical certification may or may not be required.
  • Paid time off may be substituted for unpaid leave at the employer's or employee's request.
  • The company will continue to pay its percentage of health premiums during the leave.
  • The company may require the leave in certain circumstances.
  • The company may require periodic status reports.
