Bart shared his apartment with another student, Fred. Bart told Darrell that he could take Fred's gun that was in a dresser drawer in Fred's bedroom. Darrell walked into the bedroom and took the gun along with some bullets. Bart told Darrell to return the gun before the weekend, when Fred would return. Darrell replied that he couldn't promise when he would get the gun back to Bart. Darrell took the gun with him and drove away from Bart's place. Darrell drove to the bank he wanted to rob. He was able to park directly in front of the bank. Somewhat distracted, however, Darrell parked in a loading zone. A police officer noticed Darrell and stopped him as he exited the car with the gun, in his waistband. In the course of ticketing Darrell, the officer discovered the gun, at which point Darrell blurted out his plans to rob the bank. Fred told the police that Bart did not have permission to loan his gun to Darrell. Darrell has been charged with larceny of the gun and attempted robbery of the bank.
