Daniel is a lorry driver, transporting vegetables and fruits to retailers in Singapore. He normally transports them on weekdays, giving him much time to spend with his family on weekends. His trips are on a daily basis from Kuala Lumpur to Singapore. He has been transporting the vegetables and fruits for the last 24 years and thus, he has earned a good reputation as a reliable transporter in the transportation industry. Recently, Daniel contracted with Equinox Fruits and Veggies to transport vegetables and fruits to Singapore. Equinox Fruits and Veggies stated that the vegetables and fruits must be sold at a profit margin of least 30%. As Daniel was transporting the vegetables and fruits, the Malaysian government made an announcement that there should not be any vehicles travelling out of Malaysia in view of Covid - 19 effective from 18th March 2020. At the time the announcement was made, Daniel was in Melaka, which is about three (3) hours away from Singapore. The announcement was made on 17th March 2020. Daniel is now confused. If he returns to Kuala Lumpur with the vegetables and fruits, it will be spoilt. If he sells them at Johor Bahru, the profit margin will be very much higher. But he was afraid that the vegetables and fruits will be spoilt since the air conditioning system is faulty thereby the vegetables and fruits were beginning to deteriorate. Hence, he decided to sell them off at Melaka to a buyer named Fresh and Go although the profit was not 30%. Equinox Fruits and Veggies now claim that Daniel was never instructed to sell the vegetables and fruits at Melaka. Furthermore, the sale does not benefit Equinox Fruits and Veggies at all.
