Defendant is charged with theft of a vehicle. The defense theory was that Defendant purchased the vehicle from a car salesman and that Defendant did not know it was stolen.As part of this defense strategy, Defendant's son was called as an eyewitness to the purchase of the vehicle and testified that he was present when Defendant purchased the vehicle from a car salesman and personally observed much of the paper work in the exchange of title. On cross examination, the prosecution wants to ask Defendant's son questions that attack the character of the Defendant by inquiring about prior convictions of the Defendant for transporting stolen cars across state lines. Defendant's lawyer objects to the prosecutor's line of questions that attack the Defendant's character.
