For this second assignment, you will have a chance to experience a mock deposition in our Navient case. You will be in groups of two or three where you will switch off playing roles: the questioning lawyer and witness/defending lawyer. Your group will together do two or three depositions of different figures in the Navient lawsuit so that each of you can have a chance to play each role.
The depositions will be of the following witnesses:
- A loan counselor at Navient
- A borrower with Navient who was eligible for public service loan forgiveness but
instead was counseled to put loans in forbearance
- A personal finance expert who will be testifying on the financial consequences of
burdensome student debt
For example, the student playing the loan counselor could act as a questioning attorney for the personal finance expert and defending attorney for the borrower; the student playing the borrower could act as the questioning attorney for the loan counselor and defending attorney for the personal finance expert, and the student playing the personal finance expert could act as questioning attorney for the borrower and defending attorney for the loan counselor. Just make sure everyone has a chance to play each role.
Preparing for the deposition will require you to develop a narrative for your witness, plan questions for the deposition that you are taking, and review the rules for objections for the deposition that you are defending.
