The hospital, on Dobos's doctor's orders, asked Nursing Care Services, Inc., to perform nursing services for two weeks while Dobos was in the hospital and for a second two weeks' period while Dobos was at home. Mrs. Dobos, who was mentally alert during the at-home period, later argued that she should not be liable fro Nursing Care Services, because she had neither signed a written contract nor orally agreed to be liable for these services.
