Don't be afraid to include the facts and to discuss them thoroughly. Use the facts!! You will see arguments from both sides, e.g., defendant's point of view and plaintiff's point of view. There could be counter-arguments and those should be included as well. You want your audience to understand the rationale behind the discussions. Cite the case law that you are discussing. For example, S.E.C. v. Tambone, 597 F.3d 436 (1st Cir. 2010). Notice how it is italicized. The case that you are discussing will reference a case law like in the above example. You should include the case law in your discussion section. For example, The issue(s) before the courts is/are ... Then, state the rule of law and cite the case law (S.E.C. v. Tambone, 597 F.3d 436 (1st Cir. 2010). For example, in case ..., the court held (rule of law). The conclusion is the strongest/winning analysis/argument and how the court came to that conclusion
