Discuss in the following circumstances whether a duty of care can be established for negligent misstatement(s) in the following circumstances and whether the maker of the statement could be sued in negligence for the statements made:- (Total: (25 marks) i) A false negative and careless reference was given by an ex-employer to the current employer of Mr Y resulting in him being dismissed from his job during the probation period. He also alleged that the remarks was so bad that it ended his career. ( 8 marks) ii) Mrs X seeks an advice from a tax consultant in which she wanted to find a way not to pay inheritance tax for the money she intend to give to her beneficiaries under her will. However, the consultant gave such advice which resulted in her beneficiaries eventually having to pay substantial inheritance tax upon her demised. The beneficiaries sued the tax consultant. (8 marks) iii) XYZ, audit firm was sought by the law society to make annual reports on their client ( a law firm). The audit firm failed to detect a large scale fraud by their client. The law society, as a result of reliance on the report, suffered lost. It was argued that if the fraud was detected, the law society could have prevented the fraud from taking place. (9 marks)
