Discussion 04B: Tilly Teacher, five feet tall and 100 pounds, is very angry - not at anyone in particular - but just in general, and this fact is immediately evident to her students when she enters the classroom. She purposefully strides into the room, jabs a finger in the direction of Sal Sport, star quarterback, sitting quietly in the back of the room, glares at him and forcefully says, "Sal, I'm going to knock your block off." Sal snickers. Has Tilly Teacher committed an assault? (To answer this, you must know the legal definition of assault.)

Suppose Tilly Teacher enters the classroom, still clearly angry at the world, puts her hand in her pocket, and withdraws a gun. She waves the gun in the air aimlessly and somewhat menacingly, ultimately (for no apparent reason) pointing it right at Sal, saying, "Sal, I'm going to blow your brains out." Has Tilly Teacher committed an assault?

Suppose Tilly Teacher does pull the trigger. The gun goes off, and the bullet whizzes over the head of Sal - so close that it parts his previously unparted hair --- very neatly. In fact, the new part improves his look. He not only looks great, he suffers no physical injury of any kind. He is not bruised, and there is no open wound. Has Tilly Teacher committed a battery? An assault?
