Disney hired Joan to take telephone calls for the Walt Disney Company. Her job is to make restaurant reservations for people visiting the Florida theme park. To get the job, Joan had to complete a Disney training and pass both a written and oral test. She had to make the experience magical for customers as almost all customer reserving spots at the restaurant she reserved spots for were celebrating an event and Disney wants to make everything magical. Disney provided a scrip, the training, and an online reservation system. Joan worked out of her home and used her own phone and computer. Joan lives in Kansas with two kids and needs a job she can work from home and that provides flexibility.Joan was required to work at least 30 hours per week but could choose her hours between 5:00 a.m her time zone and midnight her time zone. She was free to take breaks whenever she needed them but was only paid for the periods when she was on a call or available to receive a call. Every call Joan received was recorded and many were monitored by Disney.
Joan signed an agreement that she was an independent contractor and not employee. Disney did not take payroll taxes our of her pay, nor did it pay workers compensation or unemployment insurance.
