Esmerelda has decided to open a restaurant called "Von Crum with a very low tum" using the logo in Picture 2 below. She is not registering her logo, but the classes relevant to Esmerelda's business would be Class 31 for coffee (as she intends to sell her specialist coffee from the restaurant); and class 43 for restaurant services providing food and take way foods. Explain to Esmeralda whether her logo infringes Peter Alexander's trade mark in class 31 and class 35, under the Trade Marks Act 1995. Use appropriate cases and sections to illustrate your answer.
