Dr. Shelby Martin began employment at Miracles Plastic Surgery Center. At the beginning of his employment he signed a two eyar employment agreement with the company. During negotiations for his position and benefits, the managing partner, Dr. Allen Richardson, told Martin that she would become a partner in the firm.and that during the term he would be paid "like a partner." The written agreement did not reflect this promise. The contract stated that Dr. Martin would be paid on "net profits" for her services and never indicated that she would become a partner. Later Richardson told Martin that the practice did not intent to make her a partner. Dr. Martin then sued Miracles Plastic Surgery Center. During the trial Richardson did not dispute Martin's account of the conversation that took place prior to the signing of the contract.
