Draft a Motion for Temporary Family Law Order and Restraining Order.  You can name the parties and develop your own fact pattern, with the following caveats:

Neither party is an Active Service Member in the Military

There is no need for protection-order type restraints.

This is not a short-term marriage and there is a significant disparity in the parties' incomes with your party being the inferior earner. 

There are minor children and parenting is at issue - this will be a custody battle and both parents want to be awarded the primary residential placement of the children.  

Your client wants to be awarded the use of the home on a temporary basis, and ask the other to be moved out.  

Your client's narrative declaration need only be skeletal, meaning that you are going to give very short descriptions of the facts to support the prayers for relief.  THIS IS NOT WHAT WE DO IN REALITY; THIS IS THE EXACT OPPOSITE OF ACTUAL PRACTICE!!!! IN FACT, IT IS THE EXACT OPPOSITE - THE NARRATIVE DECLARATION IS WHERE WE CONVINCE THE COURT TO RULE IN OUR CLIENT'S FAVOR.

For this assignment, the focus is twofold - 1)  to get the formatting of the motion/declaration done correctly and 2) - to demonstrate your understanding of the supporting pleadings that should (must!) accompany this filing.  For this second part, please type up a list (on a separate piece of paper) of the supporting documents your judicial officer will be providing.  For the list, go through each and every section of the motion and state the title of the section and what other documents you would provide for the judicial officer - what proposed order(s) are necessary for that section, and what other submissions are required and/or helpful for the decision maker.
