During the last semester break Ahmad has hired a deck chair from Pantai Bersih Resort Sdn. Bhd. in Port Dickson. On the chair there was a statement which reads 'The company shall not be responsible for any injury caused from the use of any facilities provided by the company'. A similar statement however did not appear at the payment desk. Ahmad got injury while using the chair. While sitting the chair was broken due to the rust. Ahmad claimed damages from Pantai Bersih Resort Sdn. Bhd. but the company refused to pay. Can the company use the above statement as a defense?
