1. In the form of IRAC, students need to analyze the New York Wrong-Site Surgery and Fraud Case, In Re Muncan, 745 N.Y.S.2d 304 (N.Y. App. Div. 2002) using the IRAC format discussed in class. This case is briefly discussed on page 246 of the textbook in Chapter 10.
2. Students need to define the elements of fraud and how this case meets the elements of fraud.
3. Students need to analyze the "Hospital Universal Protocol" National Patient Safety Goal issued by the Joint Commission on hospital accreditation. How do universal protocol measures help prevent wrong site, wrong procedure, and wrong person surgery related "Never Events?"
