Ed is a college professor. He teaches a class which is scheduled to run on Tuesdays from 2-5pm. Last week, class ran late. He kept his students longer than normal and they did not leave class until 5:15pm. He didn't think much of the issue at the time. He apologized and didn't think about it again. However, Laura, as student in his class was greatly inconvenienced by the delay. She had an important appointment at 5:30 and was anxious to get there as soon as possible. She got in her car and sped to the appointment, reaching speeds of almost 200 kilometers/hour. Just before she reached the place of her appointment, as she was speeding through an intersection, she failed to see that the traffic light turned red. She smashed in to a car crossing the intersection. Both cars were a total loss and both Laura and the other driver were badly injured. Laura was furious and blames Ed for the accident; she believes that he is to blame because if he didn't let the class out at 5:15 that she would not have to speed to reach her appointment. Which of the following is correct? a) Ed is liable because he had a contractual obligation to release the class at 5pm b) Ed is not liable because the accident because of the principle of "Volenti Non Fit Injuria" c) Ed and Laura are equally liable because they both contributed to the accident d) Ed is not liable because of the principle of "Stare Decisis" e) Both A and C f) None of the above
