Ellie is an experienced journalist at the 'Griffith Daily', an online newspaper. The head office in Brisbane, where Ellie is currently employed, has 30 staff members. All staff must complete an annual 2 hour training session on anti-discrimination policies and workplace health and safety each year. Ellie has worked in the industry for over 15 years and has been with the Griffith Daily for 12 months. She has asked Mike, her editor in chief, on numerous occasions to allow her to cover the more serious, high profile news stories. Mike has always refused, and assigned the serious news stories to John, a journalist with 2 years experience, who has only been working at the Griffith Daily for one month. During her 12-month performance review with Mike, she says that she would like to start covering more serious news stories and that she doesn't think it's fair that a less experienced journalist like John should be getting the high profile stories. Mike tells Ellie, "I want one of the boys covering those tricky stories, because you women are just too nice, and you don't ask the tough questions". He then inappropriately touches her knee and squeezes her thigh, and says, "Having said that though... I'm sure we can come to some sort of arrangement." Ellie jumps from her seat and says "I think you misunderstood, I just want to write serious news articles" and runs out of Mike's office. Ellie makes a verbal complaint to the Head of Human Resources, Dustin about what happened in Mike's office and tells Dustin that she plans to make a formal written complaint against Mike. Question 5 (7.5 marks) Using only the Anti-Discrimination Act 1991 (Qld) and the supporting common law, advise Ellie as to whether she can bring a complaint against Mike for direct discrimination and whether the Griffith Daily is vicariously liable for Mike's actions. (You are NOT required to discuss indirect discrimination, exemptions, procedure or remedies). 6 Question 6 (7.5 marks) Ellie would like to know if she can sue Mike and/or the Griffith Daily because Mike touched her leg, and for his suggestive comments during her performance review. Advise Ellie on this issue using the Anti-Discrimination Act 1991 (Qld) and the supporting common law. As part of your answer, you should discuss the procedure Ellie should follow to bring a claim, and what remedies (if any) are available to Ellie.
