Emily has a small business selling sweet and savory pastries from her food truck. Emily notices that her truck is due for servicing. She decides to service it immediately as she is selling her pastries at the Perth Food Festival in 2 days' time and needs to ensure the food truck is in working order. Emily takes her truck it to her usual mechanic Al's Mechanics' for a full service. Emily tells Al that she needs a full service on her food truck and to make sure the engine is in good working order. Al tells Emily that he will do so, and she can pick it up at the end of the day. At the end of the day Emily picks up her food truck and pays AI $600 for the service. Al gives Emily a report of the service that states both the truck and engine is in good working order. Her next service is in 6 months. The next day, Emily is driving to the Food Festival to sell her baked goods when the truck begins to stall and comes to a complete stop. Emily tries to re-start the truck but after 15 minutes of failed attempts to start the truck Emily decides to call roadside assistance and they charge her $179 to tow her truck back to Al's mechanic. On investigation, the truck's engine has overheated due to faulty servicing of the engine's cooling system. Al confirms this and apologises to Emily. Emily is angry at Al because; she will have to pay $500 to fix the cooling system in her engine, she's paid $179 for roadside assistance and she has lost $3,000 in profits from not being able to sell her pastries at the Perth Food Festival. In your own words, explain whether Emily can sue Al for the following losses: - $500 to repair the cooling system, - $179 for roadside assistance, and - $3,000 for lost profit
