Employment Contract Assignment You have been asked to draft an employment contract for a Social Media Manager role at FITO IT Solutions (hereinafter "FITO"), an Ontario company with 24 locations which provides IT and web design services to residential and corporate clients. This type of business is subject to provincial regulations. FITO has interviewed several candidates and wishes to present an offer of employment to Breanna Yu. It is anticipated that Breanna would commence with FITO in their corporate headquarters on February 22, 2021. FITO wants Breanna to grow the company's presence on 5ocial media as a way to attract more clients. FITO is very concerned that its proprietary interests be protected. In other words, Breanna should not be able to remove any company information or contact any clients of the company. A few years ago, an employee left and immediately used company information to poach existing clients of FITO. It cost FITO a lot of money in lost revenue. FITO wants to do everything possible to avoid a similar situation in the future. FITO will provide compensation as follows: -a base salary of $92,000 per year -eligibility in a profit sharing plan that will pay Breanna a 15% bonus if FITO profit exceeds $4 million dollars in the Fiscal year -car allowance of $500 per month, no receipts are required -an IT allowance of up to $1500 per year, which will permit Breanna to purchase laptops, software and other IT materials for her home office. Receipts are required -a learning allowance of up to $1500 per year, which will permit Breanna to attend seminars, training and other educational programming related to her field. Receipts are required and prior approval of these seminars, training and programming is also required. -five weeks of vacation after 12 months of employment and vacation pay of 10% -there is no pension or retirement plan Breanna will be expected to: -work a minimum of 44 hours per week plus overtime as needed and as permitted under the ESA -manage all social media accounts for FITO (twitter, Facebook, Linkedin, TikTok, Instagram, (Snapchat, etc) Should it be necessary to terminate Breanna's employment (without cause), FITO will provide three weeks in lieu of notice for every vear she is employed by FITO.
