Enrique and Janice met at university and have been married for 4 years in the UK. Enrique, who is 27 years of age, is a Marketing Manager earning 55,000/per annum. Janice is 24 years of age and is a fitness instructor earning 25,000/per annum. They have one child, Dorothy, who is 1 year old. They live in Central London in a 2 bedroom flat which they own jointly. In September 2023, Janice suspected that Enrique was having an affair with his colleague, Sally. She found out some intimate texts on Enrique's phone in October 2023 showing he had been communicating with Sally since May 2023. Enrique denied the affair stating the texts were simply immature jokes between colleagues. Janice believed him and they continued as normal. However, in January 2024, Janice again found intimate texts on Enrique's phone indicating that he had met up with Sally after a work for dinner. Janice confronted Enrique but he denied it again and got angry by throwing things around the house. Janice doesn't trust Enrique, is scared of him and wants to divorce him. What legal options are open to her to bring her marriage under the Divorce, Dissolution and Separation Act 2020 and consider any challenges she may face by Enrique under the Act.
