Eoghan, in anticipation of getting a job as a trainee accountant wishes to purchase a second hand car. He goes to Reliable Autos to have a look around. Fergus, the salesman, directs him towards the "Deal of the Week" stand. On the stand is a 2015 Renault Megane, five door hatchback with 38,000 miles on the clock. The car is described as being in excellent condition and a bargain at only 12,750. Fergus tells Eoghan he would sell the car for 12,500 and throw in a couple of floor mats. Eoghan bought it with cash that he had saved from his part time job..

Within the first few days Eoghan noticed that there waws a knocking sound coming from the engine and that the headlights were blinking on and off intermittently. Within a fortnight, the car had broken down three times and on the last occasion had to be towed to garage.

After an examination of the car, the garage mechanic informed Eoghan that it was unroadworthy; the brakes were defective and the engine needed replacing; indeed the state of the engine would indicate that the true mileage was around 95,000. Also, the condition of the sub-frame indicated that the car had been involved in an accident which left it structurally weakened.

Eoghan, in an attempt to cut his losses, offered the car to the garage mechanic but is shocked to learn it is only worth 5000.

Discuss the rights and remedies that are applicable to Eoghan.
