Tort is a wrongful act that injures an individual or their property leading to civil legal liability; whereas, a crime is a wrongdoing that is classified by the state or Congress as a felony or misdemeanor. The purpose of a tort is to provide relief and aid to the injured party and for a crime is to make the guilty individual pay their retribution for the act that they committed. I think that what went down between Elisha's husband and the seller was a tort. I think that Elisha's husband did not intend to hurt or had any intentions of anything wrongful other than a confrontation but things got out of hand when the verbal altercation happened.
Based about torts and crimes the seller couldn't accuse Elisha's husband for the crimes as Elisha's husband never punched him or even touched him. Yelling at someone isn't a crime until they hit or touch you. In this case it says the security guard tacked Elisha's husband before he could connect a punch. In this case the seller could accuse Elisha's husband for a tort as it was a private wrong against a specific individual whereas if it was a crime it would be a public wrong against society which wasn't the case here. However, if it is the person that sold them the house I feel like Elisha and her husband can also press charges. As far as legal actions from the seller he doesn't have to take legal actions but could if he wanted to. The purpose of a tort is to prevent a individual from wrong doing to another person. The purpose of Criminal law is to keep order in society and lessen the harm to other individuals. The difference between the two is tort law refers to a civil wrong doing whereas criminal law refers to crime committed against society.
