Every judicial system is determined to find the truth in each presented case. Various commentators claim that a lawyer's responsibility is to enforce the truthfulness of a proceeding outcome in court. Lawyers, who are part of the judicial system, are required to be honest when dealing with their clients, opponents, and the entire system. The principle of honesty primarily governs them in presenting their clients. Hence, each lawyer is obligated to seek the truth, especially from their clients, in every instance. Although many lawyers are considered less ethical and honest in the current economic and political climate, lawyers are obligated to act in good faith and honestly. This paper provides an argument whether lawyers have a professional obligation to seek the truth in every instance. The judicial system applies honesty and truthfulness to regulate lawyers' conduct when representing their clients. Lawyers should be guided by professional responsibility rules that demonstrate the requirements needed in dealing with the opposing counsel, clients, third parties, and courts (Nicolaides & Vettori, 149). When lawyers are honest in taking positions or providing information, this helps them to understand how to solve challenging issues while practicing law. Being truthful facilitates a better ethical judgment for a lawyer. In some instances, lawyers are not obligated to seek the truth. For instance, defense lawyers avoid being engaged in a certain version of events by not seeking information on what their client did or failed to do. Such lawyers have ethical constraints in their minds. They cannot legally provide false evidence, meaning they do not let clients commit perjury. Several individuals appear to be leery of lawyers, mostly defense lawyers, in terms of ethical grounds. Their main argument is that they lack sound morals. The claim is they interfere with the truth for monetary gains. Such lawyers are not interested in morality or objectivity. Although there are such claims, many lawyers desire to get the client's truth on what exactly happened. Lawyers should seek the truth for them to make an effective defense for the client. For instance, a lawyer in charge of a case where a lady has killed the boyfriend should seek to know everything during the event and in their relationship course. Suppose such a client admits the killing to the lawyer but illustrates terrific emotional and physical trauma suffered under the man. In that case, the lawyer can craft an effective defense according to the history of abuse.Typically, clients and their lawyers should certainly discuss various facts fundamental to the criminal charges. The lawyer should have some details about the case. Otherwise, they may fail to effectively advise their client concerning the defense theories and the viability of even going to trial. Acquiring the truth about the charges helps the lawyer to formulate a good strategy.Generally, lawyers have a professional obligation to seek the truth in every instance. The truth helps formulate a good and effective defense strategy for their clients. Although there are claims where some lawyers, especially defense lawyers, interfere with the truth for monetary gains, a lawyer should act ethically and remain truthful in every instance when representing their clients. They should be steered by professional responsibility rules that determine the requirements required in dealing with the opposing counsel, clients, third parties, and the entire judicial system.
