Before the due date of the delivery of the thing, a tsunami occurred in the place of A, which resulted to the car that was supposed to be delivered be severely damaged up to the point that it cannot be fixed anymore. In this case, B cannot oblige A for the replacement of the thing destroyed for such has been destroyed because of a fortuitous event (Acts of God).

Art. 1263. In an obligation to deliver a generic thing, the loss or destruction of anything of the same kind does not extinguish the obligation.
