The following are the five elements of fraud and deceit concerning the sale of real estate:

1. False representation made by the defendant;
2. Scienter;
3. The intention of the defendant to induce the plaintiff to act or refrain from acting in reliance;
4. Justification for the plaintiff's reliance; and
5. Damage to plaintiff.
