FarmFresh Meatworks is in a newly developed area of Mitchell in the ACT. There is not much traffic in the street where they are located as it is a "No Through Road". Street lighting has not yet been erected on the street, at present there is only a single security light over their loading dock. Because it is such a quiet street, truck drivers loading or unloading stock at the Meatworks usually park in the middle of the street so that the FarmFresh forklift can access both sides of the trucks. Although truck drivers have been parking in the middle of the street without incident, they have only previously done so during the day. FarmFresh are trialling a new delivery schedule, in which their trucks are loaded at night due to new businesses arriving in the street. Patrick, a truck driver employed by FarmFresh, had parked in the middle of the street, in order to load his truck. Patrick switched on his parking lights but did not realise that the back left-hand light was not working. The quietness of the newly developing area also makes it an attractive place for learner drivers to practice their driving skills. One evening last week, Hamish, a 21- year old who had just received his full licence, offered to take his 18-year-old neighbour Mandy. out for a practice drive. Hamish scrolled through his mobile phone messages and did not watch Mandy's driving. Mandy had just received her L-plates but had only driven once or twice before. Mandy drove into the street, and at that same moment Hamish looked at a newly arrived message on his phone. When Mandy (belatedly) saw the truck, she panicked, but instead of hitting the brake, she hit the accelerator, crashing the car into the back of the truck. Both the car and the truck have received considerable damage, and both Mandy and Hamish were rendered unconscious by the impact. They also received extensive cuts and grazes.
