The stakeholders in this scenario are Apple, FBI, and the American people. In this scenario, Apple is risking its reputation, the FBI is risking violating the constitution, and the American people are put at risk as a result. Apple's decision to not assist the FBI in helping hack the criminal's phone made a strong case for the violation of free speech, however it also stalled the government agency from being able to decipher important information from the terrorist's phone. This directly affected the American people, because it meant that the reaction time to a potential threat was slower than it could have been. In my opinion, Apple should have assisted the FBI. This is because I saw it through the scope of act utilitarianism, which judges the morality of acts as individual events (Gilbert, 2016). In this case, the ends do justify the means because not only is it certain that this individual poses a threat, it also grantees the safety of the masses. However, if one were to look at this through the lense of Rights and Duties, or Fairness and Justice, I may arrive at a different conclusion. Rights and Duties causes one to judge the morality of an act based off the rights of others and takes note of the duties that these rights bind the actor to (Gilbert, 2016). Through this perspective, Apple is defended in their claim that unlocking the phone would be a violation of privacy. They, as a company, have a duty to keep their client's information private and secure. Alternatively, the Fairness and Justice approach leans more towards keeping things proportional in every situation; things must always be defensible and fair (Gilbert, 2016). When using this technique, it could be argued by either the FBI or Apple. This is because both parties' arguments align with upholding individuals' rights and liberties; privacy and safety.
