\f\fLife Skills Memorandum Name University Affiliation The Church of Narnia v ABCD Company is a typical law of contract case. I predict that the ABCD Company will win this case if it were to go to court. We go back to the elements of the contract referred to above. In this case, we focus on only 3 elements: 1. Offer 2. Acceptance 3. Consideration An offer for donation was made by the ABCD Company to donate $5 million. The offer was accepted by the bishop of the Church of Narnia. The Church of Narnia did not however give any consideration for the agreement. In law, this is what we call a gratuitous agreement. A contract cannot be gratuitous. Both parties must give consideration .Consideration is anything of value, as money. Consideration for this Contract was that ABCD Company would give $5 million. The Church of Narnia did not give ABCD Company any consideration in return. They only expected the agreement to be honoured without offering anything of value in return. This was a gift being offered. A gift is not enforceable by the law. (Bayles, 2017) A valid contract was therefore not constituted in this case. Since a contract was not formed, then ABCD Company did not breach any contract when they refused to honour their pledge to donate the money. The bishop of the Church of Narnia misled himself when he decided to depend on the promise of a donation to pledge his own money. This is a life skill that everyone must learn. You cannot rely on promises entirely as the basis of an investment. References Bayles, M. (2017). EBSCOhost | 58776722 | LEGALLY ENFORCEABLE COMMITMENTS.. Web.b.ebscohost.com.
