Five accused persons namely, A, B, C, D and E had the intention of killing the Z, the victim. The five accused were arrested by police authorities on 10th November, 2021 for the murder of Z from the crime scene. However, after further investigation, the police authorities apprehended P, the sixth new accused who was the member of the group and facilitating A,B,C,D and E in the commission of the murder of Z but not present at the crime scene. When the abovementioned matter (murder) went up to the trial court on 22nd November, 2021, 02 accused persons, namely D and E were acquitted by giving benefit of doubts. Now the question arises, which Section of IPC, 1860 will be applicable to decide the culpability of accused(s), i.e. A, B, C and P. In each case substantiate your answer with the sufficient reason and case law wherever required.
