For a use-of-force policy to meet constitutional requirements, there are certain considerations that need to be followed. The agency would need to emphasize the importance of valuing and preserving human life, according to the department of Justice. The department would also have to only allow the use of deadly force when it is necessary, which is when the officer has reasonable belief that the subject poses an imminent danger of death or serious physical harm to the officer or another person. The policy would state that the officer's require training at least annually, and de-escalation tactics and techniques and that these are used before deadly force is implied as a last resort. The policy would also include that the officer would render medical aid as appropriate. This policy would be made public via the webpage of the agency.

The policy should contain things that are not allowed but not limit them. An example would be the officer will not place a civilian in a face down restraint, officer will not place a civilian in a choke hold of any kind, and no use of carotid restraints except when deadly force is authorized.

The policy should outline what use of force is and that "Law enforcement officers should use only the amount of force necessary to mitigate an incident, make an arrest, or protect themselves or others from harm. The levels, or continuum, of force police use include basic verbal and physical restraint, less-lethal force, and lethal force (Justice Department. 2024). The level of force the officer needs to use is based on the situation. The goal of the officer is to regain control of the situation as quick as possible while protecting the community. There should also be information about excessive use of force.
