FACT PATTERN 4: Independent of your analysis in fact pattern 3 above, how would your analysis/conclusion be impacted if you discovered the following four (4) additional bits of information: (Note to students - consider these four bits of information COLLECTIVELY rather than independently) a. The seller is selling the extensive crystal collection of his deceased mother. In connection with an earlier auction of another piece, Mary had contacted the seller with a question. As part of the e-mail communications, Mary learned that seller's father had been in the military stationed in Europe and that many European pieces etc. had been acquired during that time. Thus, Mary claims she had no reason to question the legitimacy of the rare piece listing. b. Seller claims that he is not an expert and doesn't know from light reflections, viewing the piece from the top down etc. He claims that his listing only stated what he saw - and to him, from the angle that he was looking at the piece, the top was green. c. Each of the "colors" has an official technical identification name. For example, the "yellow" is called "Sahara", "green" is "Inngreen", "purple" is "Helio", "violet" is "Volcano" etc. At the same time that Mary's carousel auction was running, the seller had other auctions running. The other auction listings included ones for a "Helio" cone shaped piece, a "Volcano" cone shaped piece, and an "Inngreen" round piece. (In each of these auctions, the piece was properly identified by its technical colorname and photos showed the view directly down from the top rather than at an angle). In each of these other auctions any flaws were fully described as to number, size and location.
