Ted Maintenance is a MRO and was engaged by a small regional airline, Foster Airways to service its aircraft avionics systems. Peter Lim was appointed as the engineering representative from Ted Maintenance to handle engineering issues of Foster Airways. Every month, Foster will send cheques to Ted Maintenance for the services rendered. Early in March 2017, Peter explained to Foster Airways that Ted Maintenance is facing some cash flow problems and would give 20% discount if the airline could pay Ted Maintenance in cash through him. Foster Airways agreed and paid a total of $300,000 to Peter over a period of six months. Peter disappeared in September and Ted Maintenance demanded Foster to pay the outstanding amount for the past six months as it had not received any payment. Realising that Peter had misappropriated the amount, Foster intended to contest the demand of payment by pointing out that since Peter was an employee of Ted Maintenance, Ted Maintenance should be responsible for Peter's action.
