Frank works with Susan in a small medical office. He had often had concerns about Susan. although she was nice and he liked her. It seemed she did not take her job responsibilities seriously. She never reviewed the policy and procedure manual if she was uncertain of what to do: she rarely attended any of the skill fairs for review of how to safely use equipment; her documentation was minimal; and while nice to the patients, she spoke little and explained less. When he questioned her about any of these behaviors and asked if she was concerned about making an error. she would flippantly comment that thefacility carried liability insurance and was responsiblefor what she did and did not do. One busy afternoon shetook a call from a concerned mother whose infant was spiking afever. She told the mother she would notify the physician and ask the MD to return the call. Facility policy dictated that Susan document this call in the MD's inbox. place a text to their beeper. and follow this up with verification that the needed contact was made by placing a note in the computer with her record of the call. Susan completed none of this. The infant suffered a fever-related seizure and was rushed to the Emergency Room. The family sued. The facility asserted that Susan's actions were egregious (so unreasonable as to be indefensible). This negated any responsibility the insurer had to provide legal defense for Susan as Respondeat Superior (the master [boss] is responsible). Shethen was responsible for the entire cost of her defense. Susan used all her savings to pay for a lawyer, was found guilty, and the plaintiff was awarded a five- figure sum which Susan would never be able to pay. nor was she employable in the health care profession ever again.
