Fred and Naomi married 10 years ago and were initially very happy. Things changed soon after the birth of their daughter Neka. Fred started to go out with his friends every Saturday night, leaving Naomi at home with Neka. Fred frequently returned home drunk, waking Naomi and Neka with his raucous singing. One night, whilst returning home after a night at the bar, Fred crashed his car. Fred was severely injured and left with permanent paraplegia. Naomi visited Fred ever day whilst he was in hospital but when Fred returned home, Naomi realized the marriage was effectively at an end. Naomi however continued to cook for Fred and would help bathe and dress him.  Naomi did not tell Fred of her feelings but began to have an affair with Barney, their neighbour. Naomi told Barney she would never leave Fred whilst he still needed her. However five years after the accident, Naomi moved out of the matrimonial home to live with Barney. Naomi took Neka with her. Naomi said that Fred's depression and irritability had proved too much for her and she was no longer able to cope with the strain of taking care of Fred. Fred has refused to consider a divorce, saying he needs Naomi. 

Advise Naomi whether she can petition Fred for a divorce under the present law.
