Parson had regularly retained Lynn to act as his agent on the sale and purchase of property. Lynn alleges that she had been retained by Parson to act as his agent in connection with the purchase of two neighbouring properties with development potential. Lynn contended that a retainer had been agreed orally and that correspondence between the parties in relation to previous purchases was evidence of an agreed standard commission rate when instructed to act on behalf of Parson as a purchaser. Parson adopted the position that although Lynn had been involved in the purchase to a certain extent, there was no written retainer, no subsequent invoice for commission and no other evidence that Lynn had been instructed to act as his agent.
