GameSG is a Singapore registered company that develops online educational games. To-date, GameSG has developed three (3) types of games for business schools on Simulation, Role-Play and Strategy that closely replicate the real world with various scenarios to explore the key elements of a situation while providing an immersive experience for learners. GameSG employs a group of eight (8) programmers and engages four (4) independent programmers to create educational games. All employees and independent contractors are resident in Singapore. E (Ctrl) The employees developed the code for the online games on Simulation and Role-Play; while the independent contractors developed the code for the online game on Strategy. The online educational games are sold and accessed through a high-speed 1.2 GBps connection via a platform operated by the company and hosted on its servers that are based in Singapore. GameSG's management team are interested in developing an IP strategy to fully exploit their online educational games and has asked you to resolve the following: (a) Analyse if the three (3) online games enjoy copyright protection. (b ) State the general position on ownership of copyright works. Propose, with reasons, which party owns / parties own the rights to the three (3) online educational games. (C) Determine the actions that GameSG need to take before they can release the three (3)online educational games for sale.
