Gary is in a process to open a motor spare parts business in central Johannesburg. He is negotiating with an agent in Nigeria to import the parts. Gary's friend informs him that he can get the parts cheaper from an agent in Zimbabwe. Gary informs the agent in Nigeria that he will import the parts from Zimbabwe. The Nigerian agent indicates to Gary that if he does not conclude a contract with them. that there will be consequences and that they do know where Gary and his family resides. Gary does not want to put his family in any danger and therefore enter into an agreement with the Nigerian Agents.

Answer the following:

(a) List the requirements of a valid contract.

(b) With reference to the above-mentioned case study evaluate if the requirements for a valid contract were met. In your answer also include the remedy available to Gary.
