- Senior JudgeLaurence Silberman wrote a very striking dissenting opinion in a defamation case calling for a reconsideration of the landmark Supreme Court case of New York Times v Sullivan. He said that things have changed in the last fifty (50) years since New York Times v. Sullivan was decided. He went on to say that the New York Times is no longer the New York Times. He further states that the New York Times used to be an objective newspaper of record. Today Silberman says that the New York Times is the party organ of the democratic party. It has become a predictable newspaper. In other words, we cannot trust the media to give us unbiased assessment of the news.
