Grey intended to host a major barbecue for his business clients in July on some recreation property her owner. A major feature of the barbecue would be a whole lamb roasted on a spit. He made arrangements on June 3 with Donaldson, a farmer in Sooke, to deliver a butchered lamb, ready for roasting a day before the barbecue. In fact Grey actually viewed the lamb at Donaldson's farm while he was out in the area. At that time Donaldson told him, "You're lucky. This is the last lamb I have." Grey paid Donaldson $300 for the lamb right then and there. Unfortunately, a week before it was to be delivered, the lamb was attacked and eaten by a cougar in the area. Donaldson advised Grey of this and expressed his regrets. When Grey said, "You can send me a cheque returning the money I paid you." Donaldson said, "Wait a minute. You get your money back and I'm out a lamb! Sorry, old chap, I'm not obliged to pay you anything back." Grey intends to take Donaldson to Small Claims court over the matter.
