Group Project Issues

Your group is to select six of the following issues, locate a case in which the issue is litigated,

and prepare a $4-5$ sentence summary of the case. You may select a case from any jurisdiction,

and it can either be a federal case or a state case. The insurance policy can be any liability policy

unless otherwise stated. If CGL policy is stated, the case can involve any version of the CGL

policy $($Not just the $00010413$ version$).$ USE REAL CASES

Whether the claim asserts "bodily injury" as that term is defined in the liability policy?

Whether the claim asserts "property damage" as that term is defined in the liability

Whether the CGL policy's exclusion L applies to the claim for "property damage"?

Whether the CGL policy's "impaired property" exclusion applies to the claim for

"property damage"?

Whether the claim arises from a "personal and advertising injury" as that term is defined

in the CGL policy?

Whether the insured's violation of a policy condition precludes liability coverage for the

claim asserted?

Whether the workers compensation claimant was injured while in the "course & scope"

of his employment?

Whether the person seeking coverage qualifies as an insured under the Business

$($Commercial$)$ Auto Policy?

Whether the "bodily injury" or "property damage" claim arises from an auto accident

under an auto policy?
