The loan agreement stated through a contract clause that the government would advance further funds midway through the school year. Gurpreet stopped attending classes in October for medical reasons but did not advise the university which was against one of the terms of the loan agreement. He used the funds for living expenses instead of for tuition, which was in clear contradiction to the loan agreement. The university informed the government that Gurpreet was not eligible for the second installment of his loan, and therefore the Ontario Government refused to advance the money Gurpreet sued the government for breach of contract and sought damages in the amount of $1 million.
