He is keen to explore hair loss treatments as his wife constantly teases him of his baldness. One day he sees an advertisement dropped in his letter box. He reads the advertisement and to his delight discovers that a company called Forever Young Pty Ltd is promoting its product a "Eureka" hair cream for sale.

According to the advertisement, any consumer who purchases the Eureka hair cream at the retail price of $50 per bottle and applies the cream daily will see significant hair growth in that area being treated within 14 days. It further states that a full refund will be made if there is no significant hair growth observed by the consumer after 14 days. In addition to a full refund, a bonus of $100 will be paid to each and every dissatisfied customer.

The advertisement has instructions as to how an online purchase order can be made. It also states that it is a condition that consumers who have children will not be entitled to any refund or bonus. This is because according to the company's inconclusive and ongoing research, the presence of children can potentially lead to hair loss.

Harry immediately makes an online purchase of one bottle of the Eureka hair cream and pays $50 with his credit card. The company despatches his order in the mail on the very next day. He applies the cream on his head daily for 40 days consecutively but to his dismay there has been no significant hair growth on his head. He has sent an email to the company requesting for a full refund as well as the bonus but the company has not responded to his email.
