Harry lives in Los Angeles, California, and owns another home in Santa Barbara. In 1991, Harry makes a Will, and leaves his first Santa Barbara home to his son, Able, and his primary residence to one of his key employees, Baker. Over the years, Harry acquires two additional homes in Santa Barbara, and all of his Santa Barbara homes are within five miles of each other.

Harry's last home purchase in Santa Barbara was with his sister, Carol, and title was held in joint tenancy. Carol's Will leaves all her property to her son, Dan.

Several years later, Harry changes his Will by himself to read "my Santa Barbara home located in the township in the fourth tier north of the base line and the third range east of the principal meridian also known as "township 4 north, range 3 east" or "T4N, RJ3", goes to my secretary, Suzy."

Harry and Carol are in an automobile accident. Harry dies instantly, and Carol dies two months later. Harry and Carol's estates both proceed through probate.

At the end of Harry's Will, he had included the following statement: "After the specified property is distributed, all of the rest and residue of my estate consisting of all my remaining real and personal property goes to my favorite real estate agent and nephew, Dan, for his years of faithful service."
