Hector was renovating his house and wanted to install several light fixtures and increase the number of electrical outlets available in the
basement. His neighbour recommended someone named Gwen, who had done some electrical work for her when she fixed up her
kitchen the previous year. Hector contacted Gwen and they negotiated a contract for Gwen to provide and install 10 light fixtures in the
basement ceiling as well as 12 electrical outlets. The light fixtures, electrical outlets, and necessary wiring would cost $2,800.00. Labour
for installation was quoted at $2,200.00. During a conversation, Hector realized that Gwen was not a licensed electrician. Checking with
a friend who took a business law course at college (and of course you know the textbook that was used), Hector learned that anyone
operating as an electrical contractor in the province was required to have a valid licence issued under the provincial statute. When Gwen
presented her account to Hector for payment he responded, "Shocking as this may be, you're not a licensed electrician and I'm not
paying you a cent." (~ LO 6.1, ~ 6.2, ~ 6.3)
a. Can Hector refuse to pay Gwen under the contract? If so, on what basis?
b. Gwen's contract required her to provide light fixtures, electrical boxes, and wiring as well as services as an electrician. Can Gwen
enforce any part of the contract with Hector? If so, on what basis?
