Judges and attorneys need to understand and be aware of mental disorders in the children and adolescents they are dealing with. Not having an understanding of their disorders could, in fact, hurt the child or adolescent. "Simply put, there is the very real risk that the system can do more harm than good to a child who is still in the process of neurobiological, psychological, social, and moral development. Because of this, the negative consequences of careless sanctioning may be more enduring for a child (and for society) than they might be for an adult" (Arredondo, 2003). In looking at the brain development of children with mental illness "while the process of normal brain development itself puts juveniles at risk for behaviors that may be at odds with societal expectations, juveniles with mental illness may be at added risk of running afoul of the legal system. Indeed, a study of 1829 children (1179 boys and 650 girls) in a Chicago detention center demonstrated that nearly 75% of the girls and more than 66% of the boys had one or more psychiatric disorders. 64 The Colorado Supreme Court recognized as early as 1975 that mental illness can play an important role in the juvenile justice system" (Oberstar, Anderson, Jenson, 2005).
